As the article has rightly put, most of the unconstitutional laws passed
overnight were overruled by the court. It should be noted that Kenya has
one of the most Independent judiciary in the region. Infant, the public
perception of the Judiciary and criminal justice system has improved
tremendously as compared to previous years.

It should be note the threshold for admissibility of digital evidence is
very high in any court of competent jurisdiction. I don't see the new
evidence act changing the game. Just deleting an offending tweet or
Facebook post is enough to cause the prosecutor sleepless nights. Any
screenshot of a tweet or Facebook post will not suffice in our courts,
unless Facebook and Twitter themselves corporate with data requests. From
experience, we knows such requests are honored 0% of the time. The Silicon
Valley types have no respect for our Judicial system.

Finally, there is a bill of rights in place, that among other things
guarantee freedoms speech, expression,and association.
