Superficially so.
Under the current constitution, can SUPKEM (or anyone else for that matter)
legally ban private individuals watching DSTV? If not, call the police or
whatever other law enforcement authorities you have and get them on the
case. End of. Neither a very fruitful constitutional nor ICT debate.
That enforcement of existing laws in Kenya isn't always very impressive is a
different story.
Religious leaders can recommend all sorts of stuff to their congregations,
and do. They can forbid pre-marital sex, and the members of their community
can decide to follow that - or not. Not enforceable under Kenyan laws.
