I am not sure legitimate interest would stack up especially because they
have to prove that it was necessary. This is a situation of "wanting to
have" rather than "needing to have" our WhatsApp info for FB's business
purposes. They know they can't satisfy that threshold in the EU and that is
why they are not pushing the revised terms in that market.
