This has become the norm in Kenya now. The trend has become to licence activities which never used to be licensed.

 

I remember the Science, Technology and Innovation Act of 2015 (I think) which became law and requires licences for any kind of research. In other words, you cannot do research as part of your business without getting a licence.

 

There was an attempt to form the Kenya Accreditation Agency (another privately sponsored bill by Hon. Duale) which failed.

 

We recently had ICT Practitioners Bill which flopped.

 

(I’m sure there are many others which do not directly impact me.)

 

Now this… it’s copy cat scheme to privatise rights.

Dear Listers,

There will be a stakeholders meeting on the *11th of October 2016* at the
Louis Leakey Auditorium, National Museum, to discuss the proposed film bill
from 8.30am.

Each guild or association is supposed to forward the names and contacts of
at least 7 members so that they can attend the forum. I was wondering
whether Kictanet is aware of this?

The proposed film bill will definitely have an impact on the ICT community,
including ISP providers.

As a filmmaker, I am very concerned with a lot of the details in the
proposed bill. Here is just one example:

Interesting.

1. I thought a KFCB already existed, or which is that one of Mutau who
  has been having problems with US visa and suppressing and opposing
  LGBT rights and atheists?
2. It's like an afterthought that someone decided to throw in the
  computer games. Is one supposed to obtain a licence to write or
  create these games like with films. The part of the document that
  deals with films and stage plays substantively does not deal with
  computer games.
3. The part about ISPs is thrown in by someone who is completely
  ignorant. ISPs do not deal with content; they don't even see it
  (and they should not!). An ISP is just a conduit or facilitator. Do
  these people expect an ISP to employ people to screen content of
  their clients?
4. If we are not careful Kenya will start going backwards as more people
  come up with all kinds of proposed legislation; what is there to stop
  film makers moving to neighbouring countries and taking all those
  jobs with them?
