I am re-posting the ruling made by Justice Majanja on 18th January 2013, which I believe is the basis of CCK's moving ahead to shut down the illegal transmitters. Others were warned and complied including Capital FM.
I urge listers to read before judging CCK.

Let me say that I am talking as someone who engaged previously in applying for frequencies for a set of stations. CCK has very clear requirements and one of them is not to interfere with others' frequencies.

do.
Can we all put politics aside and ask ourselves this
question: If any of the presidential candidates' helicopters went down due to
interference on aviation spectrum, who will take the blame for it when the
usual investigative commission is set up?
Let us get serious. This is a very serious issue. If
these frequencies are intefering on aviation spectrum and lives may be
lost, yet they were not authorised, what really are we debating about
here?
Now, really!
