The application, as is marketed, obviously violates the rights of the
individual. However, there are numerous use cases for these types of
software that do not violate the rights of the individual. For instance, a
company that wishes to ensure company cell phones are used only for business
purposes can inform users that the phone is monitored. The user is then free
to choose how to use the device in the face of this new information.

Banning applications of this sort (if it ever comes to that) would be
counter productive as we can then argue that monitoring email is a violation
of the employee's rights to privacy. Therefore any software that allows
organisations to do so would be illegal. There goes Microsoft Exchange :)
