<div>There is a recurring theme in the arguments made in support of the media shutdown (and other absurd administrative decisions). That the media ought to be tamed because many are dissatisfied with their reporting standards (read politricks etc). The other

 common theme is that the media has a greater moral responsibility hence deserve severe punishment when they fail to live up to this moral standard. This is the same argument Ezekiel Mutua makes every time he attacks an artists work and even programs by the

 media houses eg 10 over 10, something I find consistently unconstitutional. </div>

<div>I’ll take us back to Article 34; we always emphasise on the freedom of the media but we forget that in the same breath, the Constitution guarantees their independence. Which means, individual media houses get to decide what they will air as a business

 strategy (let us not pretend- the bottom line is a healthy balance sheet). Allow me to be careless enough and say- if a media house’s strategy is politricks, they are well within their right to broadcast tricks. That the media houses themselves chose to self-regulate

 is commendable and patriotic, yet not mandatory. </div>

<div>Any moral pedestal we would like to hold the media houses to, has to pass the Article 33(2) test. Whether something passes the test or not, is a constitutional court’s prerogative; not the executives. Yet it seems that we have set a different test for

 media houses especially during electioneering periods which we vaguely call ‘responsible reporting’. And like every other Kenyan slogan, you repeat that word enough times in pressers, people start to think it’s a constitutional test- it is not. What is ludicrous

 about this situation is that the executive dictates what is responsible and what is not- of course anything that paints them in a bad light is irresponsible! There can be no doubt whatsoever that this shut down is unconstitutional. But looking at recent events,

 it is part of a trend- runaway disregard of the constitution. </div>

<div>I keep asking myself- how are constitutions made stronger? I’d like to think that one way is by swallowing whatever prejudices we may have (yes, we don’t like the media right now, but they have a right to be so let them be). Constitutional rights cannot

 be subjective and our defence of them shouldn’t be either. </div>

Let me give a bit of background on why media owners may be taking the quiet road on this one. After President Uhuru Kenyatta was sworn in in 2013, and thereafter he named his cabinet, the Ministry of information moved forward with an idea that had been floating

 around for a while. To streamline government spending on advertising and several associated areas under one body. Meant to create synergy through bulk and then save government money, the move saw government then channel all advertising cash through the Government

 Advertising Agency.</div>
