I disagree with you on this. You seem to forget about Natural Justice. This sort of thing should not be allowed to continue. I'm with Mwendwa on this. Why create uncertainty and anxiety? When the CA was created the board was dissolved and a 'new' one was put in place. 

This new dispensation of government/Parastal jobs being advertised while incumbents are still in place is just plain wrong. Something must be done otherwise we will continue to see litigation being the only option for the wronged.
